Conditions of participation & data protection

Competition Etrusco NEC entrance tickets competition 2024

Participation in the competition “NEC entrance tickets competition 2024” from Etrusco is free of charge, regardless of the purchase of Etrusco products and is governed exclusively by these conditions of participation. By acknowledging these conditions of participation and deciding to take part in this competition, these conditions of participation are accepted.

1§ Organizer

The organizer of this competition is Etrusco GmbH, Ölmühlestrasse 6, 88299 Leutkirch im Allgäu (hereinafter referred to as “Etrusco”).

2§ Eligibility to participate

All natural persons with legal capacity who have reached the age of 18 and are resident in the UK are eligible to participate. Employees of Etrusco and their direct family members and all persons involved in the conception and implementation of this competition and their direct family members are not eligible to participate. The term "immediate family members" includes all of the following: spouses, cohabiting partners, children or stepchildren (whether natural or through adoption), parents, stepparents, grandparents, step-grandparents, siblings, step-siblings.
Only one entry per participant is permitted in the competition. Each participant can only enter in their own name; the personal details must be true. It is strictly forbidden to use multiple addresses or profiles to increase the chance of winning. Participation with false identities or with the identities of third parties is not permitted and will result in exclusion from participation.

3§ Exclusion from participation

Etrusco reserves the right, at its own discretion, to exclude persons from participation if there are legitimate reasons. This is the case, for example, if there is reason to believe that a participant is violating applicable law, the rights of third parties, the provisions of these terms and conditions or the rules of the game, in particular in the case of:

  • Manipulation in connection with access to or conduct of the competition
  • False or misleading information in connection with participation in the competition
  • Insulting, derogatory or discriminatory contributions
  • Contributions that glorify violence, are xenophobic, pornographic or racist
  • Contributions with political or advertising content
  • Contributions that violate competition, trademark or copyright law.

In this case, regardless of any further rights, Etrusco is entitled to take the following measures in particular:

  • Exclusion of the participant with immediate effect
  • Deletion and/or blocking of the contributions made available by the participant
  • Subsequent withdrawal, if necessary, reclaiming the prize and drawing a new winner.

4§ Competition participation

To take part in the competition, the following must be observed and followed: The participant registers for the competition using the form to be filled out.

5§ Participation period

Participation is only possible within the participation period. Attempts to participate after the closing date will not be taken into account in the draw.

Participation in the competition is possible from September 19th, 2024 0:00 a.m. to September 30th, 2024 11:59 p.m.

6§ Object of the prize

10 x 2 One-day tickets for the NEC Motorhome and Caravan Show 2024 will be raffled off. This will take place from September 19th, 2024 0:00 a.m. to September 30th, 2024 11:59 p.m. The winner is free to choose the day of their visit.
Not included in the prize are all other costs beyond mere admission, such as travel, accommodation and meals.
Paying out a prize in cash or in kind, exchanging it or transferring it to other people is excluded. The winner can waive the prize. In this case, Etrusco reserves the right to draw a new winner.

7§ Determination of the winner

The winner will be determined after the closing date in a random draw among all participants who took part in the competition during the participation period and in compliance with the other conditions of participation. If the competition is linked to certain participation actions, only those participants who have carried out the participation actions correctly will be entered into the draw.

8§ Announcement of the winner

The winner will be announced by email to the winners after the winner has been determined.

9§ Notification of winnings & participation in winnings

The winner will also receive a direct message from Etrusco via the email address provided on the form. The winner must then contact Etrusco by email within 3 days of being notified of winnings.
If the winner does not contact Etrusco within 3 days of being notified of winnings, the prize will not be awarded. If the contact details provided are incorrect, Etrusco is not obliged to find out the correct addresses. Disadvantages resulting from providing incorrect contact details are at the participant's expense. If a prize cannot be delivered for reasons for which Etrusco is not responsible, the right to the prize will expire without compensation.

10§ Delivery of the prize

The tickets will be sent digitally via the email address provided on the form.
If the prize cannot be handed over for reasons for which the winner is responsible, the right to the prize will be forfeited.

11§ Early termination of the competition

Etrusco reserves the right to terminate the competition prematurely at any time, even without observing deadlines and without prior notice and without giving reasons, in whole or in part, or to change its course if it is not possible to guarantee that the competition will be carried out properly and as planned for technical reasons (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons. This also applies if Etrusco's promotional guidelines are changed during the competition so that it is not possible to carry it out in accordance with Etrusco's valid regulations, or if the competition is stopped by the platforms used to carry out the competition.

12§ Liability

The following exclusions and limitations of liability apply to Etrusco's liability for damages, without prejudice to the other statutory requirements for claims: Etrusco is liable without limitation if the cause of the damage is based on intent or gross negligence.
Furthermore, Etrusco is liable for the slightly negligent breach of essential obligations, the breach of which endangers the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which makes the proper conduct of the competition possible in the first place and on whose compliance the contractual partners regularly rely. In this case, however, Etrusco is only liable for foreseeable, contract-typical damage. Etrusco is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
The above limitations of liability do not apply in the event of injury to life, body or health, for a defect after assuming quality guarantees for the quality of a product and for fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
Insofar as Etrusco's liability is excluded or limited, this also applies to the personal liability of Etrusco's employees, representatives and vicarious agents.
Insofar as claims arise due to or in connection with a raffle trip or individual travel services, Etrusco is not liable for this.
In particular, Etrusco cannot be held responsible for any technical faults, in particular network, electronic or computer failures. Etrusco is not liable for the availability of Facebook and the comment function used there and cannot be held liable for technical faults that occur there.

The participant confirms and guarantees to Etrusco that his or her entry in the competition does not violate legal regulations, common decency or the rights of third parties (e.g. trademark, name, copyright, data protection or youth protection law). In particular, he or she also undertakes to obtain the legally required consent of those involved/affected/authorized, for example the photographers or the people depicted or named, before posting texts, images or other content. The participant releases Etrusco from any claims by third parties that result from a breach of these obligations and agrees to compensate Etrusco for all damages resulting therefrom, including reasonable legal defense costs.

13§ Data protection

In order to take part in the competition, you must provide personal data (first and last name & email). The participant assures that the personal information he or she provides is true and correct.
Etrusco is responsible for the collection, processing and use of participants' personal data. Etrusco will only use the participant's personal information and other personal data within the framework of the statutory provisions of data protection law. DATA PROTECTION DECLARATION in accordance with Art. 13 GDPR

§1 Information obligations for competitions

Etrusco GmbH is a company based in Germany and is responsible within the meaning of the GDPR. The data that you send us is stored in our centralized customer database in Germany.

§2 Purposes and legal basis for the processing of your personal data

The collection and processing of personal data is based on the provisions of the GDPR. We collect and process your surname, first name and email address. The legal basis for data processing in the context of the competition is based on your voluntary consent in accordance with Art. 6 Paragraph 1 Clause 1 Letter a) GDPR. The winners will be contacted separately by email in order to collect the data required to fulfill the prize. To participate in the competition, the personal data will be collected, processed and used for the purposes of processing the competition in accordance with the conditions of participation.

§3 Data transfer within the group

Your data may be passed on within the group for administrative purposes. If data is exchanged within the group, this is done to process the competition or based on your consent. There may also be an interest in passing on this data for internal, administrative purposes. If your data is processed outside of Europe, this transmission will be carried out in compliance with all applicable data protection laws.

§4 Data transmission to other recipients

Data will not be transmitted to other recipients. If data is transmitted to other recipients, this will only happen if this is necessary for the processing of the prize. We use service providers to support us in carrying out the competition. They only act on our instructions and process the data only for the specified purpose. Any further use does not take place and requires legal permission or consent.

§5 Data transmission to a third country or an international organization

Data will not be transferred to a third country or to an international organization. This only takes place if suitable guarantees are in place within the meaning of Art. 44 ff. GDPR.

§6 Existence of automated decision-making including profiling

We do not use automated decision-making or profiling.

§7 Storage period

After the competition has been carried out or after you have revoked your consent, your data will be deleted unless there are statutory retention periods. The winners' data will be stored for the further processing of the prize distribution. Depending on the type of competition, legal storage requirements may also apply for follow-up measures (e.g. for vehicle use and the associated user contracts/transfers)

§8 Your rights

You have the right at any time to obtain free information about your stored personal data, as well as the right to correction, data portability and deletion of this data; if statutory retention periods prevent deletion, we will have it blocked. You are also entitled to object to the processing of this data or to request that we restrict processing. You also have the right to lodge a complaint with a supervisory authority.

If the data processing is based on your consent, you can revoke this at any time for the future.
